Are Democrats' Tactics to Delay Kavanaugh Nomination Actually Working?

National Archives may not finish reviewing Kavanaugh documents before end of October

As a result of this voluminous documentation, Stern concluded that "we will not be able to complete our review of all of the records that you have requested by August 15".

With the U.S. Supreme Court building in the background, Supreme Court nominee judge Brett Kavanaugh arrives prior to meeting with Senate Majority Leader Mitch McConnell on Capitol Hill in Washington, U.S., July 10, 2018.

Senate Democratic leaders have promised to fight Kavanaugh's nomination, which requires Senate confirmation. He instead speculated that the Archives would be able to meet Grassley's request over a prolonged stretch, writing that "we can complete our review of the textual records and the subset of White House Counsel Office emails "from" Kavanaugh (approximately 49,000 emails) - totaling roughly 300,000 pages - by approximately August 20, 2018, and now expect to be able to complete the remaining 600,000 pages by the end of October 2018, all of which would then be followed by notification to the PRA representatives".

Some Democrats say they are concerned that Kavanaugh will not keep President Trump in check. He said he could not reach an agreement with Feinstein over the scope of the documents request.

The documents could be produced earlier via a separate source: the Bush presidential library, which is conducting its own review.

Manchin's remarks mean he did not commit to voting for or against Kavanaugh ahead of the confirmation hearing that could take place as soon as September, with the goal of replacing retiring Supreme Court Justice Anthony Kennedy before the next court session begins on October 1. "I think they will have a good sense of what is out there on Kavanaugh". Having to examine that many documents would only delay the process at the request of a lot of senators who aren't voting for Kavanaugh anyway, he said.

The documents being compiled are only the initial request from Republicans. They said Grassley's initial request was sufficient and that senators would have hundreds of thousands of records to review on the nomination even without the staff secretary documents.

Sen. Orrin Hatch (R-Utah) has had enough of the partisan fighting over Brett Kavanaugh, President Donald Trump's nominee for the Supreme Court, and his frustration boiled over during a press conference Thursday, according to The Salt Lake Tribune. "I'm exhausted of partisanship, and frankly, we didn't treat their candidates for these positions the way they're treating ours". He further complained about what he called "dumbass" partisanship over Kavanaugh's nomination.

Yet in a potential complication for Republican hopes to hold confirmation hearings next month, the National Archives warned Thursday that it would not be able to fulfill the GOP's request for documents until October.
