Huawei takes United States to court, claims ban unconstitutional

"We are compelled to take this legal action as a proper and last resort", Huawei Rotating Chairman Guo Ping said in a statement.

Chinese tech giant Huawei on Thursday said it is suing the United States over a law introduced previous year that bans government agencies from buying its equipment.

Huawei has announced it has filed a suit against the U.S. government as a result of restrictions placed on the use and purchase of Huawei products.

Huawei claims the USA statute blocking Huawei equipment from developing 5G networks hinders competition and hurts the economy.

The most recent high-profile target was South Korean retailer Lotte, which sold land to the Seoul government for a USA anti-missile system opposed by Beijing.

On Thursday, Guo said that "Huawei has not and will never implant "backdoors". "And some major telecom companies operate joint ventures with the Chinese government, but the NDAA has signaled out a few and ignored the back of the supply chain", Song Luiping, Huawei Chief Legal Officer said.

Huawei is taking its fight against the U.S.to the courts.

Huawei's CFO Meng Wanzhou leaves her family home in Vancouver on Wednesday.

"Lifting the NDAA ban will give the US Government the flexibility it needs to work with Huawei and solve real security issues", Guo said.

Washington wants to put Meng on trial on fraud charges for allegedly violating Iran sanctions and lying about it to USA banks, and the case has become a major headache for Ottawa.

It also accused the USA government of hacking its servers and stealing emails, while smearing the company without any evidence, and blocking its ability to compete in 5G technology around the world.

Relations between Canada and China have deteriorated sharply since Meng's arrest.

China suspended a trade deal with Norway and restricted imports of Norwegian salmon after the Nobel Peace Prize was awarded to Chinese political prisoner Liu Xiaobo in 2010.

Canadian citizens Michael Kovrig, a former diplomat and now an analyst with Brussels-based global conflict monitoring think-tank Crisis Group, and Michael Spavor, a businessman and consultant, were detained after Meng's arrest. "Huawei has an excellent security record and program. No contrary evidence has been offered".

Washington has pressured other countries to limit use of its technology, warning they could be opening themselves up to surveillance and theft of information.

US officials and industry executives have long harbored questions about Huawei's ties to China's government, and concerns about its technology have mounted in lockstep with its growing success. It is unclear where the two Canadians are being detained in China, and at least one does not have access to legal representation, sources previously told Reuters.

Shifting tone, Ren in mid-February said Meng's arrest was politically motivated and "not acceptable".
